OCALA - The woman accused of stealing thousands of dollars from Big Sun Youth Soccer League would face no more than two years in prison if she enters an open plea to the court, a circuit judge made clear Thursday.
That's still too long for Priscilla Bellcase, her attorney and even the victims.
Three Big Sun Youth Soccer League board members told Circuit Judge Hale Stancil Thursday that although they want Bellcase adjudicated guilty, they prefer she be spared jail time.
The 41-year-old is charged with one count of first-degree organized fraud for allegedly stealing in the range of $40,000 to $79,000 from the non-profit organization between September 2005 and July 2007 while she served as treasurer. The charge carried a maximum 30 years in prison.
A trial date has been set for the week of May 18, but months have passed in the year-and-a-half long period since charges were brought, with nary a deposition taken.
Mark Shelnutt, Bellcase's attorney, has indicated in court hearings he would prefer the case be resolved without a jury trial, although as May 18 draws near, his options are quickly running out. He pleaded with the judge to take sympathy on his client, a single mother who is paying him reduced legal fees.
"That's all we're asking for, just a chance," Shelnutt said, as he requested withheld adjudication in exchange for probation time for Bellcase to pay back the funds. "Just give her a chance like anyone else."
In the next weeks, Bellcase can elect to go to trial or propose a plea offer that must be acceptable to the State Attorney's Office, the Big Sun Youth League Soccer board and the judge, who has taken a hard line on seeing to it that Bellcase serve some time behind bars.
"You're talking about a substantial amount of money," Stancil told the parties Thursday. "If you can steal $50,000 and get probation, doesn't that send a message out it's no big deal?"
Big Sun president Brian Behan told Stancil during Thursday's hearing that he wants an outcome in which Bellcase is convicted for the record, but for "humanity" reasons be spared jail time.
"We absolutely feel beyond a shadow of a doubt that adjudication of guilt is a necessity for us," he said. "It was a flagrant abuse of responsibility of someone else's money."
Behan said the league, which consists of youth recreational and competitive teams for approximately 2,000 children and 200 adults, is still $30,000 in debt, but that it is rebounding.
Last August, the board chose to reject Assistant State Attorney Jeremy Powers' pre-trial intervention offer, which would have required Bellcase to pay complete restitution and perform community service for 18 months in exchange for dropping the charge.
"A PTI agreement is nothing more, in our opinion, than a slap on the wrist," Behan said.
But the Big Sun board cannot have it both ways.
Stancil cautioned the parties the May 18 trial date stands firm and unless the defense can propose a plea offer before then, the case will proceed to trial.
If Bellcase pleads open to the court, she is still subject to a sentence the judge sees fit.
"I think prison is appropriate in this case. I make a lot of decisions I don't like to make, but there's some decisions you make because you feel it's appropriate," Stancil said. "That's life; you call it like you see it."

What Do I do When I See Lightening?
Jul 21, 2008
Lightning Safety Policy
The safety of our players and volunteers is of utmost importance. Therefore, the following guidelines are established- to be followed by all who utilize the Big Sun and Rotary properties.
1. Volunteers in leadership positions (Board members, referees, and coaches) are charged with the duty to monitor conditions and advise the players and families. We may utilize an air horn to indicate field closure.
2. Understand SAFE shelters. Evacuation sites include: a.) Fully enclosed vehicles with the windows up. b.) The concession stand and bathrooms. c.) The low ground.
3. UNSAFE SHELTER AREAS include the metal bleachers and pavilion. AVOID trees, water, high ground, and open fields.
4. Lightning’s distance is easy to calculate: Utilize the Flash-to-Bang count: At the sight of lightning begin counting. If thunder occurs before 30 seconds, you should already be seeking shelter.
5. If you feel your hair standing on end, and/or hear crackling noises” – you are in lightning’s electric field. Immediately remove metal objects (including baseball cap), place your feet together, duck your head, and crouch down in baseball catcher’s stance with hands on knees.
6. Wait a minimum of 30 minutes from the last observed lightning or thunder before resuming activities.
7. People who have been struck by lightning do not carry an electrical charge and are safe to handle. Apply first aid/CPR immediately and get emergency help promptly (911).
“If you can see it, flee it; if you can hear it, clear it.”
If you can hear thunder, prepare to evacuate. If you see lightning, suspend the activity
Games or practice, no one should be playing on the fields during any lightening.
Coaches should be responsible and follow these guidelines.
